About the Conference

The value of Mediation as a form of dispute resolution has in recent years been gaining prominence in Ireland. Disputes are an inevitable element of human interaction and society needs to develop efficient and innovative methods of dealing with them. This conference provides a unique opportunity for presentations and panel discussions by some of the leading experts in the fields of mediation as form of civil, commercial and workplace dispute resolution. Following these panel discussions, the leading US mediator, Kenneth Cloke will deliver an exclusive workshop to the delegates.

Why Mediation Matters

Mediation matters, now more than ever. It is playing an ever increasing role within the Irish courts, businesses, HR departments, and the public sector. Furthermore, by May 2011, the EU Directive on Certain Aspects of Mediation in Civil and Commercial Matters must be transposed by all Member States, including Ireland. This Conference will focus on recent mediation developments and will explore the future of mediation in resolving civil, commercial and employment disputes. The Conference will feature presentations from leading experts in the field of mediation both from Ireland and the UK and it also include a workshop with leading US mediator, Kenneth Cloke.

The Conference is aimed at professionals who have an interest in learning more about how mediation works in practice and how it can assist them in resolving disputes. Kenneth Cloke

 

As Director of the Center for Dispute Resolution in Santa Monica, California, Kenneth Cloke has served as a mediator, arbitrator, attorney, coach, consultant and trainer. Ken specializes in resolving complex multi-party conflicts which include: community, grievance and workplace disputes, collective bargaining negotiations, organizational and school conflicts, sexual harassment and discrimination lawsuits, and public policy disputes. Ken also provides services in designing preventative conflict resolution systems for organizations.

Speakers

Kenneth Cloke – Leading Mediator in the United States, Director for the Center of Dispute Resolution, Santa Monica, California.

Kenneth is a nationally recognized speaker and author of many books and journal articles on conflict resolution including including Mediation: Revenge and the Magic of Forgiveness; Mediating Dangerously: The Frontiers of Conflict Resolution; The Crossroads of Conflict: A Journey into the Heart of Dispute Resolution; and Conflict Revolution: Mediating Evil, War, Injustice, and Terrorism. He is co-author with Joan Goldsmith of Thank God It’s Monday! 14 Values We Need to Humanize the Way We Work, Resolving Conflicts at Work: 8 Strategies for Everyone on the Job (2nd Edition); and The Art of Waking People Up: Cultivating Awareness and Authenticity at Work.

Kenneth is the Director of the Center for Dispute Resolution and has served as a mediator, arbitrator, attorney, coach, consultant and trainer. He specializes in resolving complex multi-party conflicts. He served as an Administrative Law Judge for the California Agricultural Labor Relations Board and the Public Employment Relations Board, as Factfinder for the Public Employment Relations Board, and as Judge Pro Tem for the Superior Court of Los Angeles. He has been an Arbitrator and Mediator for over twenty-seven years in labor management disputes, and is a member of a number of arbitration panels.

Nicola White – Course Director, Dispute Resolution Studies, Independent College Dublin

Nicola was the legal expert and principal researcher for the Law Reform Commission’s project on Alternative Dispute Resolution (ADR). The Commission’s Report on ADR: Mediation & Conciliation and the draft Mediation and Conciliation Bill 2010 were published in November 2010. Nicola has also spent time with JAMS in California, the leading private providers of ADR in the world and was a visiting scholar at Gould Mediation Center, Stanford University Law School in 2010.

Austin Kenny – Chairman, Irish Commercial Mediation Association (ICMA)

Austin is a practising Commercial Mediator and Business Consultant.  He is a CEDR accredited mediator and a member of the Council of the Irish Commercial Mediators Association.

Karen Erwin – President, Mediators Institute of Ireland (MII)

Karen is a professional full time Mediator specialising in workplace and commercial disputes. She is the President of The Mediators’ Institute of Ireland, Chairperson of the Irish Auditing and Accounting Supervisory Authority and Council member of ICMA and a member of The Institute of Directors.

Andy Grossman – Director of Dispute Resolution Services (CEDR), London

Andy is the Director of the CEDR Foundation. He is a lead training faculty member of CEDR and has been responsible for the production of many aspects of dispute resolution guidance for public authorities.

John Costello – President of the Law Society of Ireland

John is a consultant in the private client department at the law firm, Beauchamps. He has over 25 years of experience in wills and probate, tax planning, wards of court, powers of attorney and other legal issues affecting the older person. John became a member of the Council of the Law Society of Ireland in 1993.

John O’Dowd – Consultant, Organisational Change & Dispute Resolution

John specialises in organisational change and conflict resolution. He is a former director of the National Centre for Partnership based in the Department of the Taoiseach. He was the general secretary, Civil Public and Services Union between 1988 and 1997 and a member of the Executive Council of ICTU during that time. From 1981 to 1988 he was assistant general secretary of the Association of Secondary Teachers, Ireland.

Pedro Angulo – Head of HR Practice, Prospectus

Mr Angulo is responsible for the ongoing development of the Prospectus HR Consultancy Practice.  He has led the design and implementation of large-scale change and human resources interventions with both national and international clients, in the public, private and not for profit sectors.

Rhona Murphy– Head of Employment Law, IBEC

Rhona Murphy is IBEC’s head of employment law services.  She is a graduate of Trinity College where she obtained an LLB before qualifying as a solicitor in 1999.  She has worked in private practice, representing employers, employees and trade unions before joining IBEC’s legal unit in 2005.

Oisin Scollard – The Employment Clinic

Oisin Scollard is a Barrister specialising in Employment Law and legal HR. He is Head Counsel with the Employment Clinic. Oisin has advised and represented employers and employees at all levels of litigation, Courts and Tribunals. He is a qualified mediator and member of the Chartered Institute of Personnel and Development.
